Ben Whitley’s Background and Passion

Ben-Whitley-2015-new[2]

What made you want to become a personal injury lawyer?

I want to help people. The deck is stacked against an individual when they have to fight a large corporation such as an insurance company. The insurance company has vast resources, lawyers, investigators and accident reconstruction experts. Juries can even the playing field and I want to help my clients get results. That’s why I do this. I am in it for the people, not the well-financed corporation.

In your opinion, what sets your firm apart from the rest?

We are a family firm. I work with my Dad and Brother. We understand what family means and we treat our clients like our family. All clients will have all the resources of our law firm available to help them. And those resources are formidable. No matter what the case, every client proceeds from a position of strength or we don’t proceed at all.

Tell us about a case that you are particularly proud of:

I helped a man who was injured on a bicycle and sustained a significant head injury. My Dad and I were able to quickly establish the responsible party’s fault and obtain all the available insurance coverage. We acted quickly because my client needed the resources to have the very best medical care possible and to help the family take this task off their plate. What steps do you take to prepare for a difficult case?

Prepare, prepare, prepare. My client has hired me because they trust me to help them. I cannot let them down. In order to tell my client’s story, I need to know about their life, their work and their family. I need to know how the injury has affected them so that I can tell their story to an insurance company or a jury should it come down to it. I cannot do this unless I am prepared. I also hire the best experts in their field to help my clients. Knowing the right life care planners, accident reconstructionist and economist to hire in a case can be crucial. I don’t skimp on the small details, because it’s the details that matter.

What advice do you most often give to your clients & why?

You must go on and live your life as if there is not a pending legal case. In order to prosecute a case right, it takes time. The more time you can give us, the better result we can get for you. Often times, clients are stressed because there are bills to pay both for their treatment and for the normal costs of life. Have patience. We will make things right.

How do you view your role in the attorney-client relationship?

I have the duty to communicate with my clients. They can call me as many times as they would like. Every client of mine has my direct number, and when they call this number, it rings right to my desk. My clients can schedule as many appointments with me as they would like. I work for them. It’s important for a client to be able to communicate effectively with their attorney.

How long have you been representing accident victims?

I have been representing regular people who have been hurt since day one of my legal career. I now have 10 years of experience in fight for my clients and they will know that I am in this with them.

What types of personal injury claims do you specifically handle?

I handle car accident claims, workers’ compensation claims and claims against pharmaceutical companies for defective medical devices and dangerous drugs.

Why should a prospective client choose to work with your firm?

We don’t take every case that folks call us about. We are selective because we want to make sure that when we take a client’s case, we are with them to the end. We are fighting for them, and we are making sure they are being heard. We do not take the decision that a client has made to hire us lightly. This is the principal our founding partner and my father has taught us. That’s why we tell our clients, “Ask others about our reputation, ask us about our experience.”
