How Can Filing a Lawsuit Against JUUL Help Me?

How Can Filing a Lawsuit Against JUUL Help Me?

More and more individuals are coming forward with lawsuits against e-cigarette manufacturers such as JUUL. Many people, including teenagers and young adults with no previous smoking experiences, were led to believe that JUUL and other e-cigarette options were ‘better’ or ‘safer’ alternatives to smoking traditional tobacco cigarettes.

As consumers of e-cigarette products fight addition and life-threatening health effects associated with the smoking alternative, companies like JUUL are receiving lawsuits for compensation of damages incurred as a result of negligence and false advertising. Families are also pursuing legal action against the e-cigarette companies for the deaths of their loved ones who used these vapes.

For many, legal action is the only way to hold JUUL and other e-cigarette manufacturers accountable for their actions. Their deceptive marketing techniques, enticing flavors that appealed to a younger demographic, and the easily accessible and concealable device they created have contributed to the youth vaping epidemic and has proven to have life-altering consequences.

Issue with E-Cigarettes

In recent months, hundreds of people have come forward claiming that their mysterious lung disease is stemming from use of electronic cigarettes such as JUUL, a popular brand. With more and more teenagers and young adults using the new form of smoking, and contracting impairments or even death, many states are generating laws where the Food and Drug Administration (FDA) and federal law makers falls short.

The easy-to-conceal cigarette body allowed students across the country to bring nicotine into their schools and exacerbated the number of students exposed to nicotine and other chemical byproducts of e-cigarettes. Additionally, it opened a black market for people to seek out potentially hazardous pods or cartridges that were filled with the ‘e-liquid.’

The tampering of the JUUL pod’s is what many cite as the reason they contracted lung disease after a relatively short time of smoking an e-cigarette. There have been eight deaths connected to JUUL devices and more than 500 diagnosed with complications from the e-cig.

JUUL’s Deceptive Marketing

Many electronic cigarettes became popular in 2015 for offering an alternative for smoking. With electronic cigarettes, otherwise known as ‘e-cigs’ or ‘vapes’, a person could inconspicuously smoke indoors with no smell and little-to-no visible smoke in the form of water vapor. While the product was intended for use by those who were already hooked on smoking—or who were old enough to choose between burning cigarettes or e-cigarettes—the product appealed to young adults and teenagers more than any other demographic.

With fruity flavors such as Mango, Cucumber, and even Crème Brule, brands like JUUL are coming under fire for claims that they knowingly advertised to a younger demographic. Additionally, JUUL allegedly failed to warn about the dangers of using their product, leaving thousands of people trying to quit smoking after unwillingly becoming addicted to the nicotine product.

The Massachusetts Attorney General sued the e-cigarette company after evidence showed that JUUL placed ads on Nickelodeon, Cartoon, Network, and Seventeen Magazine. According to the complaint, JUUL even aided underage buyers in securing their purchases by recommending that they use a shipping address of a friend or family member in a jurisdiction where the age requirement was lower. This recommendation was given by a “Don” from the Juul Care Team via email after an order had been canceled due to failed age verification. It read, “The legal age to purchase nicotine products in Milton, MA is 21 years old and above. If you have friends or relatives in Quincy, MA, you may use their address as a shipping address for your order.”

Lawsuits Involving JUUL

From deceptive marketing, to incorrectly correlating JUUL with ‘safer’ and ‘healthier’ smoking habits, many individuals are seeking legal action against e-cigarette manufacturers. The large e-cigarette and vaping companies knowingly deceived many, leading to serious injuries and even death. Some of the injuries claimed in the lawsuits being brought forward include:

  • Severe addition
  • Heart attack or heart problems
  • Lung or respiratory failures
  • Nicotine poisoning
  • Pregnancy complications or birth defects
  • Suicidal thoughts or attempts
  • Additional complications
