Who Can Be Liable For Your Wake Forest Construction Accident?

The liable parties in your construction accident depend on your type of accident and the parties and entities involved. Some of the most common negligent parties in construction accidents include:

Your Employer

As a construction worker, your safety should be your supervisor’s priority. However, when your employer fails to watch out for your safety, you can hold them liable. Some of your employer’s negligent actions that could have led to your construction accident include:

  • Failing to give you and your co-workers proper training
  • Failing to provide you with the proper safety equipment
  • Preventing you from taking breaks
  • Rushing you to complete the job to meet goals, compromising your safety
  • Making you work in the presence of harmful chemicals without proper precautions

Property Owner

When you go to a project, you are entering a property owner’s premises. As the property owner, they must take care to make sure that their property is safe for you to work on. Our Wake Forest construction accident attorney can help you hold the property owner accountable if they:

  • Failed to correct known hazards.
  • Prevented you from implementing safety precautions.
  • Failed to secure the worksite.
  • Failed to communicate with you about ongoing or new hazards.

Co-Worker

Sometimes, your injuries can be a result of one of your co-worker’s negligent actions. Even though you are both at the same site to do the job, carelessness in their work could cause you injury. Actions that you could hold them liable for in a construction accident case include:

  • Exceeding weight limits on equipment
  • Ignoring set policies for safety and health precautions
  • Playing pranks or jokes that risk your safety
  • Failing to warn you when they are moving objects overhead

What Does North Carolina Workers’ Compensation Cover?

North Carolina’s workers’ compensation is comprehensive and can cover a number of costs you may not be able to cover on your own. Here are some of the costs that our attorneys can help you recover in a workers’ compensation claim:

Lost Wages

If your construction accident injury prevents you from performing your regular job duties, you may be eligible to receive temporary total disability benefits after a construction accident. These wage replacement benefits are equal to two-thirds of the average wage you earn weekly, up to a maximum amount set each year. Benefits are paid weekly as long as you remain totally disabled.

The amount of temporary total disability benefits you get will be based on documentation of your wages prior to the injury. Your employer will provide wage information to the insurer, who can then calculate the correct weekly payment you could receive.

Medical Costs

All necessary medical treatment you need to relieve the effects of your work injury is covered. This includes doctor visits, surgery, hospital stays, physical therapy, prescriptions, medical devices, and mileage to medical appointments.

You do not have to prove fault for your injury to receive medical treatment. Your lawyer only needs to prove that your condition stemmed from your job. The insurer will pay providers directly for all approved accidental injury care.

Permanent Disability

If your work injury results in permanent physical or mental limitations, you may qualify for additional benefits. These can include vocational rehabilitation, modifications to your home or vehicle, and lump sum payments, depending on the degree of impairment. Benefits are determined based on factors like your age, education level, and future wage-earning capacity.

A physician will examine you to determine the extent and rating of any permanent partial disability using standards set forth by the Industrial Commission in N.C.G.S. § 97-31. This rating affects the type and amount of long-term benefits available.

We are committed to the highest quality client service and one-on-one attention.
