An article from Bloomberg has provided information on the case against Johnson & Johnson for their hip implants. The article states that metal-on-metal Pinnacle hip implants that have been distributed by Johnson & Johnson have been failing at significant rates.
The lawsuits began with a woman in Montana who sued Johnson & Johnson’s DePuy unit because she suffered serious complications that led to her having to get the device removed. The metal hip device seeped dangerous materials into her bloodstream which led to a serious infection. Her claim was that the DePuy unit continued to sell the items, even after they knew of the injuries being suffered.
The company stopped selling the specific version of hip implant products that were part of the claim because of involvement by the Food and Drug Administration. You can read the full version of the article.
Johnson & Johnson faced potential punitive damages if the jury determined that the company engaged in fraud or acted with malicious intent with regard to the design or manufacture of the product. Although the jury in this case ultimately determined the implant was not defective, ruling against the woman who said she was injured as a result of the faulty implant, more than 6,000 lawsuits have been filed over the Pinnacle hips.
